Terms of Service

1. Acceptance of Terms
By accessing or using the Dentrecall platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you (the dental clinic or individual, "You") and Dentrecall ("Company"). For paying clinics, the separate Clinic Services Agreement also applies and, to the extent of any conflict, governs and prevails over these Terms.
2. Description of Service
Dentrecall provides an AI-powered recall and patient engagement platform for dental clinics across North America. The Service includes:
- Automated appointment reminders via SMS and email
- Patient recall campaigns
- Two-way SMS patient communication
- Treatment plan follow-up automation
- Analytics and reporting
- Patient data import and management
3. Account Registration and Eligibility
- You must be a licensed dental professional or authorized representative of a dental clinic to use the Service.
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must be at least 18 years of age to use the Service.
- One account per clinic. Multiple user seats may be available depending on your plan.
4. Acceptable Use
You agree to use the Service only for lawful purposes. You must not:
- Send unsolicited commercial messages (spam) to patients who have not consented
- Violate Canada's Anti-Spam Legislation (CASL), PIPEDA, or applicable US CAN-SPAM and state privacy laws
- Use the Service to harass, threaten, or mislead patients
- Attempt to circumvent the platform's security measures
- Use the Service to process data for any purpose other than dental practice management
- Resell or sublicense access to the Service without written permission
5. Patient Data and PIPEDA Compliance
You are the data controller for all patient information you upload or manage in the Service. Dentrecall acts as your data processor. You are solely responsible for:
- Obtaining valid consent from patients before sending SMS or email communications
- Complying with PIPEDA, CASL, and applicable provincial health privacy laws (e.g., PHIPA in Ontario), or applicable US state health privacy laws for US-based clinics
- Ensuring patient data you upload is accurate and up-to-date
- Honouring patient opt-out requests promptly (Dentrecall processes STOP replies automatically)
6. Subscription Plans and Billing
- Paid subscription only: Dentrecall is offered on a paid subscription basis. New clinic accounts are activated by our team before use.
- Starter Plan: $279/month CAD ($249/month billed annually) — includes 1,500 SMS and 1,500 emails per month.
- Pro Plan: $379/month CAD ($349/month billed annually) — includes 2,500 SMS and 2,500 emails per month.
- Billing is processed via Stripe. Prices are in Canadian dollars (CAD) unless stated otherwise.
- Subscriptions auto-renew. Cancel anytime before the renewal date to avoid the next charge.
- Usage above plan limits may incur overage charges where the clinic has enabled overage.
7. Cancellation and Refunds
- You may cancel your subscription at any time through the Billing settings or by contacting support.
- Monthly plans are non-refundable. Your subscription stops renewing and you keep access until the end of the current monthly billing period (based on your sign-up date).
- Annual plans are paid in full in advance on the start date. If you cancel within 7 days of the start date, you are charged for one month at the standard monthly rate, we refund the remainder of the annual fee, and you keep access for that one-month period. If you cancel after 7 days, the annual fee is non-refundable; your plan will not renew and you keep access until the end of the paid 12-month term.
- No refund is owed for overage charges already incurred or for termination by us for your material breach.
8. Intellectual Property
The Service, including its software, design, and content, is owned by Dentrecall and protected by Canadian and international intellectual property laws. You retain ownership of your clinic and patient data. You grant Dentrecall a limited license to process your data solely to provide the Service.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. DENTRECALL DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ALL MESSAGES WILL BE DELIVERED. SMS DELIVERY DEPENDS ON THIRD-PARTY CARRIERS AND IS NOT GUARANTEED.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DENTRECALL'S LIABILITY FOR ANY CLAIMS ARISING FROM THE USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 6 MONTHS PRECEDING THE CLAIM. DENTRECALL IS NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
11. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or in-app notification at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
